Real News From The Blaze' SCOTUS Splits On AZ Immigration Law

The Supreme Court announced their ruling on Arizona's controversial SB 1070 Monday morning. Striking down and upholding different portions of the law, supporters and opponents have both declared victory. Upon further review of the ruling, the "Real News" panel suggested Monday that the Court's decision may lean in the direction of defeat for the law's supporters and any hope that it could serve as a keystone for comprehensive border security and immigration enforcement moving forward.

While striking down the first three provisions, the Supreme Court upheld 5-3 arguably the most controversial portion of the law which allows enforcement to check the immigration status paperwork of individuals when they are stopped for other lawful reasons, but suspected of lacking authorization to be in the U.S. The Supreme Court’s decision implies that this provision will stand as long as it is used with caution, careful not to infringe on the rights of law-abiding citizens.

The opinion, which did not include Justice Kagan who recused herself from the case, largely holds that Congress envisioned an enforcement role for states but did not want to uphold those parts of this particular law that they see as going beyond Congress’s original scope.

On "Real News" Monday the panel dissected the mechanics of what was decided Monday, and how the key surviving provision can be implemented. While SB 1070 supporter and Republican Arizona Governor Jan Brewer claimed victory after the court's announcement, Will Cain and the panel did not necessarily see Monday's outcome fall predominantly in her favor.
