Levin: Mueller is 'investigating nothing,' obstruction of justice claims are 'absurd'

Appearing on Fox News' "Hannity" Thursday night, LevinTV host Mark Levin argued that President Donald Trump should under no circumstances sit down and talk to special counsel Robert Mueller or his Russian collusion probe.

"This is a rogue prosecutor who's investigating nothing," Levin said. "There is no underlying crime. When he got his appointment by the deputy attorney general, the deputy attorney general did not provide any basis for the appointment."

Earlier this week the Washington Post published information leaked from the Mueller probe indicating that Mueller told the president's attorneys that he remains under investigation but is not a "criminal target." The Post's story also claimed that Mueller has informed Trump's lawyers that he is preparing a report on potential obstruction of justice, to be released in the coming months.

Levin noted that the official position of the U.S. Department of Justice is that the president of the United States cannot be indicted while he is in office, a point Levin says nobody else has made. This means it's obvious, not some big revelation, that President Trump can't be a criminal target of the Mueller probe. He also dismissed the idea that President Trump's firing of former FBI Director James Comey constituted obstruction of justice in the FBI's investigation into Russian interference in the 2016 election.

"So firing a subordinate is obstructing justice? That's absurd! If that's obstructing justice, then when Mr. Mueller fired [Peter Strzok], maybe that's obstruction of justice too!" Levin said.

Levin predicted that the report Mueller is aiming to release this summer will suggest that President Trump committed obstruction of justice. Levin said that would be "outrageous."

"That leak should tell the president of the United States everything he needs to know, which is that Mueller is out to destroy him! He's out to write a report to give it to the Democrats in the House of Representatives."
