Levin: 'Where's this massive bureaucracy in the Constitution?'

Thursday on the radio, LevinTV host Mark Levin took issue with the 12 Republican senators who voted earlier Thursday with Nancy Pelosi, D-Calif., and against President Trump's constitutional use of the National Emergencies Act to secure the U.S.-Mexico border.

Many Republicans have claimed they disagree with the use of the National Emergencies Act because of its potential to violate the separation of powers, but Levin explained why Trump's use of the act is more than appropriate.

"This isn't a separation of powers issue. If it's a separation of powers issue, then every single department and agency in the federal government unrelated to defense and national security should be shut down. What's the constitutional authority for the Department of Education? What's the constitutional authority for Congress delegating its lawmaking powers to one bureaucracy after another? What's the constitutional authority for Social Security and Medicare? What's the constitutional authority for any of this stuff?" Levin said.

"There are aspects of this law, when I read it to you early on, that are very troubling to me. ... But we actually have a president of the United States, despite what the media says, who's very carefully complying with the Constitution and who chooses not to use extreme measures. He did everything he could to avoid the National Emergencies Act. ... He could've bypassed Congress altogether, according to Congress."

"You have individuals on this list who vote day in and day out to violate the Constitution for sugar subsidies, for mushroom subsidies, for all kinds of subsidies. Where's that in the Constitution? You have people on this list who vote every day to fund this massive bureaucracy. Where's this massive bureaucracy in the Constitution, if you want to get right to the nub of the matter?" Levin said.
