New Photo May Cast Doubt on Black Actress' Claim That She and White Boyfriend Were Just 'Making Out' Before Cops Cuffed Her

"Were you two doing something you shouldn't have been doing?"

A new photograph and an alleged eyewitness account may cast doubt on a claim by a black actress that she and her white boyfriend were only "making out" before police handcuffed and detained her last week.

Los Angeles police received a report of a lewd act being committed by a couple matching the description of Daniele Watts and her boyfriend, celebrity chef Brian James Lucas, aka Cheffy Be*Live. Audio revealed Watts, who starred in "Django Unchained," asked police at the scene: “You know how many times the cops have been called just because I’m black and he’s white? I’m just being really honest, sir.”

On her Facebook page, Watts wrote that she was handcuffed "after refusing to agree that I had done something wrong by showing affection, fully clothed, in a public place."

But now a photograph and a claim — reportedly from an eyewitness who viewed the action from a nearby office — may indicate that the couple was doing more than just kissing.

Los Angeles police said they received a complaint last Thursday about a couple “involved in a sexual act inside a Mercedes with the vehicle door open,” officer Sally Madera told CNN of the incident near the gate of the CBS Studio Center in the Los Angeles neighborhood of Studio City.

TMZ said it obtained photos showing Watts straddling Lucas on the passenger seat of a Mercedes with the door open. The eyewitness alleged to TMZ that Lucas' feet were on the curb while Watts' shirt was pulled up with her breasts exposed, and said she was grinding and rocking back and forth.

Someone from the office allegedly went down to the car and asked the couple to stop because people in office could see, TMZ added, but the pair reportedly continued.

There are further allegations from the alleged eyewitness via TMZ, which also obtained audio of the argument between Watts and police when she and Lucas were detained. Watts can be heard on the TMZ audio saying to the officer, “I bet you’re a little bit racist.”

Lucas wrote on his Facebook page that when they were asked to show ID, he complied but Watts refused “because they had no right to do so.”

After a while, police determined that no crime had been committed, CNN reported, so the couple was free to go.

In an interview with CNN, the host asked the couple, "Were you two doing something you shouldn't have been doing?"

Watts didn't offer a yes-or-no response, but noted again that she and Lucas were "fully clothed" in the car.

"It doesn't matter how passionately we're making out," Watts told CNN. "It's my right and my pleasure to enjoy myself."

Lucas added on Facebook that whoever called in the complaint, as well as police, “saw a tatted RAWKer white boy and a hot bootie shorted black girl and thought we were a HO (prostitute) & a TRICK (client). This is something that happened to her and her father when she was 16. What an assumption to make!!!”

The incident is under investigation, CNN reported.
