UPDATE 11:03 p.m. EST: DAYTONA BEACH, Fla. (AP) — A final appeals officer has upheld NASCAR's suspension of Kurt Busch.
Gulfstream President Bryan Moss made the decision Saturday night, ending Busch's already-slim hopes of racing Sunday in the season-opening Daytona 500. He remains suspended indefinitely.
The decision means both Busch brothers are out of the "Great American Race" for the first time since 2000. Younger brother Kyle was ruled out with a right leg injury sustained in a frightening crash Saturday in the Xfinity Series season opener at Daytona International Speedway.

DAYTONA BEACH, Fla. (TheBlaze/AP) — A three-judge appeals panel has upheld NASCAR's suspension of Kurt Busch.

Busch was suspended indefinitely Friday after a Delaware judge said the 2004 champion almost surely choked and beat a former girlfriend last fall at Dover International Speedway. Chevrolet suspended its relationship with Busch following NASCAR's suspension.
The decision Saturday hurt Busch's already slim shot at racing in the season-opening Daytona 500. He remains suspended indefinitely but has one last-ditch shot if he appeals to Gulfstream president Bryan Moss, NASCAR's final appeals officer.
That appeal would be heard tonight if Busch asks for it.
Even if Moss were to overturn the suspension, Stewart-Haas Racing has moved forward with plans to use Regan Smith in Busch's car on Sunday.

Busch made headlines last month when he testified in court that he believes ex-girlfriend Patricia Driscoll is a trained assassin.
Nicknamed "The Outlaw" in racing circles, Busch has had his share of scrapes on the track, as well as off it.
