'It's mind-blowing': Victim in alleged sexual assault caught on video shocked that Soros-backed DA won't file felony charges

The victim of a brazen daytime sexual assault that was caught on video is angry that the Los Angeles County district attorney refuses to file felony charges against the alleged assailant.

Rebekkah Pederson told KABC-TV that she was angered when she found out Los Angeles County District Attorney George Gascón failed to file felony charges against the man who allegedly attacked her.

"Did this man not see any of the footage," she asked. "I'm more angry than anything."

Pederson said that she was walking from work near the corner of Broadway and Linden in Long Beach when a man came up behind her and sexually assaulted her.

"I look down and next thing I know I feel his face right here in the corner of me and [he] lifts up my dress, pulls on my hips, and thrusts his genitals against me," she explained.

The video shows the transient expose himself as he walks up to Pederson and assault her. He fled after knocking her down. Police later arrested a suspect and identified him as 30-year-old Miguel Avila.

Gascón's office reviewed the case and declined to file felony charges. The Long Beach City Prosecutor's Office filed misdemeanor charges but said only the county DA could file felony charges.

"I think this is an egregious case," said Long Beach Prosecutor Doug Haubert. "I think the conduct warrants felony-level filing. From the moment we got it we believed it was felony level conduct."

The DA's office told KABC that it would look at the case again to reconsider filing felony charges, but Pederson is angry that the video isn't enough to file the more significant charges.

"It's mind blowing because nobody in their right mind thinks this is anything but attempted rape," she said to KABC.

Avila is behind bars on $75,000 bond and will face court next on Nov. 8.

Gascón, who won the office with the financial backing of left-wing billionaire George Soros, has been heavily criticized for his lenient criminal sentencing policies.

Pederson voiced the concern that many people have about the assailant.

"I want that guy in jail, so that he doesn't go and actually rape somebody," she said. "He's going to actually rape somebody. He will. He just hasn't been successful yet."
