Father accused of fleeing single-vehicle crash that killed teen daughter, injured family: 'She had a heart of gold'

Bodycam video shows the moment an Oklahoma father was arrested by police after he reportedly fled the single-vehicle crash that killed his teen daughter and injured other family members.

The Bixby Police Department responded to a car crash around 9:20 p.m. on Jan. 11, KJRH-TV reported. Officers found 16-year-old Shelby Binney near the site of the car accident – she had reportedly been thrown from the vehicle during the rollover car crash.

Binney was rushed to a local hospital but was later pronounced dead.

Investigators said Shelby was not wearing her seatbelt at the time of the accident and was ejected from the car.

Her mother and two elementary school-age siblings were also transported to the hospital with injuries suffered from the deadly car accident.

Missing from the car crash site was the father of the family – Elliot Binney.

The man is accused of fleeing the car crash that killed his teenage daughter.

An anonymous witness told KJRH-TV that he ran to the crash site and found a man wandering around the wrecked SUV. The witness alleged that he attempted to get the "disoriented" man to sit down, but he ran off.

"The driver, Elliott Binney, her father, at some point left the scene, he walked to a family-owned business and retrieved a vehicle," said Bixby Police Chief Todd Blish, according to KOKI-TV.

Police were able to track the vehicle electronically.

Officers tracked down Elliot down in Checotah – roughly an hour away from the fatal car crash.

The Checotah Police Department released bodycam footage of officers arresting Binney while he was behind the wheel of a gray pickup truck.

Binney told police officers that the accident was caused by him losing control of the car after hitting an oil spot on the road during the rainy night, according to the arrest report.

A witness to the car crash estimated that Binney's vehicle was traveling around 70 mph before the crash, according to the police report. Binney reportedly passed multiple cars in a no-passing zone shortly before the deadly wreck.

The New York Post reported, "When officers went through Binney’s car, they found vodka and several pill bottles with the labels torn off in the front seat, according to the footage."

Binney allegedly admitted to officers that he had bought the vodka and "took a gulp" of it while driving his family home.

Binney’s wife reportedly told police that she and her husband were arguing before the deadly car accident.

The father suffered only minor injuries from the crash that killed his daughter. In his mug shot, Binney is seen with two black eyes.

Binney was arrested and charged with leaving the scene of a collision resulting in death, first-degree manslaughter, and passing a vehicle in a no-passing zone.

Binney, 41, was released from jail on a $102,100 bond.

KJRH-TV reported Binney was previously charged with leaving the scene of an accident on three other occasions. However, the state allegedly dismissed the charges in 2010 and 2016.

Blish said, "These situations are tragic in every sense of the word."

A cheer group that Shelby participated in described the teenager as "a bright light in the gym, a hard working athlete, and the best teammate you could ask for."

"She was loved by everyone around her," the group said on Facebook. "She would always encourage others in the gym. She had a heart of gold and showed kindness to all. Shelby always had a smile on her face. She loved her teammates, coaches, and the gym. We miss her terribly."

Shelby was a sophomore at Bixby High School – which dispatched a counseling team to "provide support for any students or staff who may need help processing this very difficult news."
