Police release body-cam video after lawsuit over 9-year-old who was handcuffed at school

Florida police released body-cam video of a controversial interaction they had with a 9-year-old boy after his family filed a lawsuit against the city of Oviedo and the two officers involved.

The video shows Oviedo police responding to a call of a child cursing, screaming, and throwing objects at the mail room of the Stenstrom Elementary School in Seminole County in February.

The video shows police trying to talk to the fourth-grade boy, who is throwing objects and screaming at the school staff in the room. Eventually, the school resource officers placed the struggling boy in handcuffs.

He continued to scream curses at police and the school staff.

"F*** you, b****!" he yells at one point, and "Let me f***ing go!"

After one of the staff tries to calm him down, he screams, "Shut the f*** up, b***!"

Police say they released him after about 13 minutes, and he voluntarily left to speak to a school counselor.

Months later, the family of the boy filed a lawsuit claiming the police acted inappropriately. The lawsuit claims that the boy had an Individual Education Plan and Behavior Intervention Plan that listed “physical aggression” as a behavioral problem.

They further claim that the plan designated that school staff not react to the physical aggression and “not engage in any conversation other than having him complete the task."

The attorney of the family said the inaction of the city forced them to file a lawsuit.

“Nine-year-old children should not be handcuffed by police officers at school," read the statement from the attorney. "The City of Oviedo has failed to reach out to the family to make any effort to address this unfortunate situation. It was not my clients’ preference to initiate litigation, but the city’s failure to investigate this incident and the officers involved left them no alternative."

The lawsuit claims the incident caused extreme harm to the boy and aggravated his existing condition.
