Legal expert: Pleading the fifth is not an admission of guilt

Former national security adviser General Michael Flynn plans to invoke his fifth amendment right against self-incrimination and rebuff a Senate subpoena.

John Malcolm, Director for the Heritage Foundation's Edwin Meese III Center for Legal and Judicial Studies, told Dana Loesch on "Dana" today that invoking the fifth does not automatically mean one is guilty.

Having been both a prosecutor and a defense attorney, he noted that with multiple investigations and hearings going on, Flynn could subject himself or others perjury if he testified.
