Fraternal Twins Separated During Custody Battle Between Gay Dads

A custody battle between a TV celebrity and his partner for their fraternal twins has resulted in the children being separated -- one to each dad.

According to TMZ, WE TV's "My Fair Wedding" host David Tutera and his ex-partner, Ryan Jurica, conceived the children through a surrogate, one biologically related to each man, using sperm from each of them to fertilize different eggs that were then implanted into the same woman.

The men were joined in a civil union for 10 years, before breaking up in January. The babies -- a boy and a girl -- were born in July.

According to TMZ, a source familiar with the situation said a judge has granted the separation of the twins as at least a temporary arrangement.

"We're told David and Ryan are 'close' to a final settlement, where the temporary custody arrangement will become permanent," TMZ reported.

People magazine, however, reported that Tutera is seeking full custody of both infants with visitation rights granted for Jurica.

Jurica's lawyer, Bettina D. Hindin, sent People a statement about about the situation.

"Unfortunately, Mr. Tutera has determined to play out this matter in the public forum," the statement read. "There are two children’s lives at stake, and they should not be brought into their parents' divorce."

Tutera's representative did not offer People a comment.

Tutera was accused of having a sex addiction and hiring prostitutes, according to his former partner. But Tutera released a statement to the Huffington Post earlier this year saying these claims were "baseless and untrue."

"I am saddened by these developments; I am angered by the lies; and I am committed to moving beyond this painful moment to focus on my professional commitments and the upcoming birth of my children," Tutera said at the time.
